Hoe vraag ik een bewindvoering aan?

Een bewindvoering is bedoeld voor meerderjarigen die zelf niet in staat zijn om de eigen zaken te regelen. Het is een gerechtelijke beschermingsmaatregel, die ingesteld wordt door de vrederechter. Hoe doe je een aanvraag voor bewindvoering?

Een bewindvoering vraag je aan via een verzoekschrift aan de vrederechter. Vanaf 1 juni 2021 kun je het verzoekschrift alleen nog digitaal indienen via het centraal register voor de bescherming van de personen (zie de schermafbeelding hieronder):

Als je naar de website van rechterlijke bescherming gaat, kun je eerst ook een aantal instructiefilmpjes bekijken, voordat je daadwerkelijk inlogt in het systeem. Deze filmpjes vind je onder Vragen? -> Bekijk de hulp pagina. Ben je niet zo digitaal vaardig, dan kun je bij de griffie (secretariaat) van de rechtbank hulp vragen bij het indienen van een verzoekschrift.

Er zijn drie opties om aan te melden in het centraal register. Ben je een ouder of andere familie van de te beschermen persoon dan meld je je aan als burger. Verloopt de aanvraag via een advocaat, dan logt deze zelf in. Loopt de aanvraag via een voorziening of andere organisatie dan meld deze zich aan via de derde optie "organisatie". 

Bij het verzoekschrift voeg je een geneeskundige verklaring van een arts, waarin de gezondheidstoestand wordt aangetoond. Deze verklaring mag niet ouder zijn dan 15 dagen. Je mag daarnaast extra bijlagen toevoegen, zoals schoolverslagen om de gezondheidstoestand te onderbouwen. Je kunt ook al een suggestie doen wie je als bewindvoerder wilt aanstellen. De vrederechter kan afwijken van deze voorkeur, maar moet dan wel uitleggen waarom.

Kosten voor het indienen van een verzoekschrift bewindvoering zijn 24 euro. Je kunt een bewind aanvragen vanaf dat de persoon in kwestie 17 jaar is. Het bewind zal dan ingaan op de 18e verjaardag. Zo vermijd je een 'bewind loze' periode na de 18e verjaardag.
