Zodra iemand 18 jaar wordt, is deze persoon meerderjarig. Dit brengt allerlei rechten en plichten met zich mee, zoals stemrecht, het recht om een contract te ondertekenen of de plicht om een belastingaangifte in te vullen. Personen met een verstandelijke handicap zijn niet altijd in staat om zelf beslissingen te nemen, bijvoorbeeld wat betreft geldzaken. Om ervoor te zorgen, dat deze persoon wel zijn/haar rechten en plichten kan uitoefenen, kun je onder andere een bewindvoering aanvragen.
Wat is een bewindvoering?
De bewindvoering is bedoeld voor meerderjarigen die door een gezondheidstoestand (tijdelijk) niet in staat zijn om de eigen zaken te regelen. Deze gezondheidstoestand kan bv. een psychisch probleem zijn, maar ook een aangeboren handicap of een bepaalde ziekte. Het is een gerechtelijke beschermingsmaatregel. De vrederechter stelt de maatregel in. Voorlopers van bewindvoering waren het voorlopig bewind en de verlengde minderjarigheid. Deze bestaan niet meer sinds 1 september 2019.
Is het verplicht om aan te vragen in geval van onbekwaamheid van de persoon met een handicap?
Het is niet verplicht, maar afhankelijk van de situatie kun je ervoor kiezen. Je kunt bijvoorbeeld misschien heel lang zonder, omdat je zoon met een verstandelijke handicap steeds aan jou, als ouder, toestemming vraagt voor bepaalde handelingen. Hij weet dat hij niet zomaar iets moet ondertekenen. Op een gegeven moment kan zich echter de situatie voordoen, dat er gehandeld moet worden, denk aan de verdeling van een erfenis wanneer één van de ouders overlijdt. Als er op dat moment geen bewind is geregeld moet je zoon bij de notaris handtekeningen zetten, terwijl hij dat niet kan.
Wie kan een bewindvoering aanvragen?
Iedereen die belang heeft bij de te beschermen persoon kan in principe een bewind aanvragen. Dat kan een ouder zijn, een persoon die de zorg op zich neemt, een instelling, dit is heel breed. Ook de te beschermen persoon zelf kan een bewind aanvragen.
Andere opties?
Bewindvoering is een gerechtelijke bescherming, deze gerechtelijke procedure verloopt via de vrederechter. Naast bewindvoering bestaat ook de optie om een zorgvolmacht aan te vragen. Dit is een zogenoemde buitengerechtelijke regeling.
