Stel je kind met een handicap is enig kind en het komt te overlijden. Bij het verdelen van de erfenis gaat het dan naar de vaderlijke en moederlijke lijn, wanneer we ervan uitgaan dat je kind zelf geen partner en/of kinderen heeft. Het kan zomaar terecht komen bij een achterneef die nooit enige interesse heeft getoond in je kind. In een restlegaat kun je bepalen dat de erfenis in plaats daarvan bijvoorbeeld naar een vzw, instelling of persoon gaat die je nauw aan het hart ligt.
Het betekent concreet dat je een tweede begunstigde laat vastleggen in je testament. De eerste begunstigde is dan je kind met een handicap die na jouw overlijden zijn/haar deel krijgt. Wanneer je kind met een handicap overlijdt, gaat de rest (dat wat is overgebleven van het legaat) naar de tweede begunstigde die je hebt genoemd in je testament.
In geval er broers of zussen zijn, kun je hen ook als tweede begunstigde opgeven. Het is belastingtechnisch voordeliger om dit via een restlegaat te doen, omdat er dan sprake is van een rechte lijn in plaats van een zijwaartse lijn. Het tarief is dan namelijk van toepassing tussen de oorspronkelijke legataris en de broers/zussen (rechte lijn) in plaats van tussen je kind met een handicap en de broers/zussen (zijwaartse lijn). Dit kan bijvoorbeeld een groot verschil maken in wat je moet betalen als successierechten:
