De Raad van State oordeelt dat de actualisering van de persoonsvolgende budgetten in strijd is met de Grondwet.
De actualisering van de persoonsvolgende budgetten is een maatregel uit 2021. Deze maatregel betekende voor duizenden personen een daling van hun budget voor ondersteuning. De vzw Gelijke Rechten voor Iedere Persoon met een handicap (GRIP), een mensenrechtenorganisatie, ging naar de Raad van State samen met een aantal personen met een beperking om deze maatregel aan te vechten.
GRIP kreeg gelijk in de zaak tegen de actualisering van de persoonsvolgende budgetten. Afgelopen maandag, 8 januari, sprak de Raad van State uit dat de actualisering van de persoonsvolgende budgetten in strijd is met de Grondwet.
Dit betekent dat de Vlaamse regering aan iedereen die door deze maatregel een lager budget kreeg, alsnog het budget moet geven dat hen oorspronkelijk werd toegewezen. En dit met terugwerkende kracht. De regering zal hiervoor middelen moeten vrijmaken.
