Eind 2019 vond correctiefase 2 plaats met als bedoeling personen met een zelfde zorgzwaarte dezelfde budgetten te geven. Dit betekende simpel gezegd dat een deel van de budgetten steeg, een deel daalde en een deel personen zag het persoonsvolgend budget (PVB) omgezet worden naar rechtstreeks toegankelijke hulp (RTH). Personen met een handicap die een persoonsvolgend budget hebben, kregen een brief in de bus waarin werd meegedeeld welke invloed correctiefase 2 op hun budget zou hebben. Wie een brief kreeg en het niet eens was met de beslissing had drie maanden de tijd om hiertegen in beroep te gaan bij de arbeidsrechtbank. 648 mensen gaven hieraan gehoor, waaronder Johan Decruynaere die hierover een open brief schreef, die we hier graag delen.
Als ouder van een zoon met een mentale beperking ontvingen wij zoals velen vorig jaar een brief van het VAPH (Vlaams Agenschap voor Personen met Handicap). Het persoonsvolgend budget (PVB) dat onze 42-jarige zoon Korneel amper 3 jaar ervoor kreeg toegekend om zijn noodzakelijke ondersteuning zelf te organiseren, werd opnieuw aangepast. Het bedrag waarover hij voortaan beschikte om zijn zorg te finacieren, werd met -53% verminderd. De redenering erachter? Vanaf nu moest iedereen met dezelfde zorgnood hetzelfde budget krijgen. Gelijkschakeling met de grove borstel. Vraag is: waarom nu en waarom is er zoveel ontevredenheid?
Bij de start van de PVF (persoonsvolgende financiering) in 2017 werden onder sterke druk van de voorzieningen de subsidies die ze kregen, verdeeld onder hun gebruikers op basis van de door die voorzieningen ingeschatte ‘zorgzwaarte’. Zo konden de voorzieningen hun inkomsten verzekeren via hun gebruikers. Gevolg was dat er grote verschillen waren in budgetten voor eenzelfde zorgzwaarte. De zorgzwaarte van elke gebruiker werd aan de hand van VAPH richtlijnen door alle voorzieningen bepaald en was een bron van ongelijkheid. Ook de financiering van voorzieningen was in de loop der jaren zeer uiteenlopend geworden door diverse maatregelen en gebruikers kregen daardoor nu grotere of kleinere budgetten.
Door een correctiefase in te voeren na 3 jaar wil het VAPH elke gebruiker met eenzelfde zorgzwaarte eenzelfde budget geven, maar aan de zorgzwaarte zelf wordt niet geraakt. Er wordt zorggarantie voorzien op voorwaarde dat niets gewijzigd wordt aan de ondersteuning waardoor je gebonden bent aan de voorziening en de zorgnood uit het verleden. Terwijl persoonsvolgende financiering je precies de vrijheid zou moeten geven om zelf je eigen ondersteuning te organiseren.
Veel gebruikers die hun ondersteuning zelf georganiseerd of aangepast hadden, moeten vanaf 2020 inleveren omdat de overheid geen cent meer wilde investeren. Een budgetneutrale maatregel om het met een mooi woord uit te drukken.
Het VAPH heeft daarmee veel werk bezorgd aan de rechtbanken. 648 budgethouders tekenden beroep aan tegen de verlaging van hun budget. Hier moet toch iets niet kloppen? 648 nieuwe rechtszaken in de arbeidsrechtbanken. Die rechtszaken worden voor het ogenblik systematisch uitgesteld omwille van de covid19 maatregelen. En intussen moet de gebruiker verder zijn ondersteuning organiseren met een verminderd budget. De voorzieningen haalden hun slag thuis bij de invoering van PVF. Voor de gebruikers is er straks de eerste verjaardag van de aangevochten budgetvermindering. Het is een ongelijke strijd.
Een magere troost voor sommigen is dat sommigen door de coronacrisis in 2020 tot 25% meer budget kregen, omdat het budget maandenlang naar de voorzieningen ging, terwijl de gebruikers noodgedwongen thuis moesten blijven. Er was toch geen geld voor meer budgetten dan voorzien, werd ons jarenlang voor gehouden door onze Vlaamse regering?
