Voor de juridische dienst van het VAPH is art.23 van de grondwet niet van tel, stelt STAN-bestuurslid Johan Decruyenaere, tot de budgethouders van de rechter gelijk krijgen in hun strijd tegen een verlaging van hun zorgbudget.
Wat voorafging: op 12 april 2022 stelt het arbeidshof van Gent in een arrest dat de vermindering van het persoonsvolgend budget (PVB) in de zogenaamse correctiefase 2 in strijd is met het 'standstill-beginsel' dat bepaald is in artikel 23 van de Grondwet. Concreet betekent dit dat verleende rechten niet kunnen teruggedraaid worden en dat bijgevolg het VAPH niet mag overgaan tot een vermindering van het PVB.

Het VAPH wil meer gelijkwaardige zorgbudgetten voor gelijkwaardige profielen van mensen met een handicap in het nieuwe financieringssysteem Persoons Volgende Financiering (PVF). Een perfect verantwoorde gelijkschakeling. Alleen wringt het dat het VAPH pas 5 jaar geleden die budgetten zelf bepaalde en op voorhand wist dat er een herziening zou moeten gebeuren door de gebruikte techniek van budgetbepaling. Toch werd gestart met onjuiste budgetten.
600 budgethouders hebben de door VAPH bepaalde budgetdaling, voor sommigen van meer dan 50%, aangevochten bij de rechtbank. Veel procedures zijn nog lopend en werden uitgesteld met het oog op een uitspraak van het hof van beroep in een gelijkaardige zaak. Daarin wordt nu gesteld dat de daling van het budget in strijd is met artikel 23 van de grondwet die de wetgever de verplichting oplegt om geen afbreuk te doen aan al verleende rechten. De andere rechtszaken zullen nu rekening houden met dit arrest maar zullen nog apart behandeld worden.
Het VAPH had intussen al de daling van de budgetten beperkt van meer dan 50% tot maximum 15%. De regels werden al aangepast om het verzet te milderen.
Op de website VAPH website staat nog altijd dat correctiefase 2 gelijkschakeling beoogt. Het nieuwe arrest is voor VAPH blijkbaar geen nieuws. Het wordt in elk geval niet bij het nieuws vermeld. Ook niet hoe het arrest opgevolgd zal worden. Voor de juridische dienst van VAPH was art.23 van de Grondwet dus niet van tel. Tot budgethouders gelijk krijgen in hun strijd tegen een verlaging van hun budget. Maar dat is geen nieuws.

Rechten moeten opgeëist worden. Zoals bij de milieuzaak en het Oosterweeldedossier. Zelfs de zwaksten worden door de Vlaamse regering niet ontzien en het door België ondertekende VN verdrag voor personen met handicap is voor hen blijkbaar niet meer dan een een vodje papier.
