Wat kan ik als specifieke bepalingen in mijn testament zetten?
Niet geldelijke bedingen in een testament
Ben je ouder van een kind met een verstandelijke handicap, dan is het verstandig om goed na te denken over je testament. Daarin moeten niet alleen de zaken worden opgenomen die betrekking hebben op de verdeling van je erfenis, maar je kan er ook dingen in opnemen die te maken hebben met wat je zoon of dochter graag doet, als hobby heeft of waar hij/zij plezier aan beleeft. Door ze te benoemen in je testament, kunnen diegenen die zich over je kind zullen ontfermen, die specifieke dingen ook uitvoeren. In ons notaris-jargon noemen we deze bepalingen ‘niet geldelijke bedingen’.
Immers, als je je wensen op papier hebt gezet en er is een bewindvoerder aangeduid en eventueel (zeker en vast aan te raden) een vertrouwenspersoon, dan kan die zich tegenover de bevoegde vrederechter vlotter en makkelijker verantwoorden indien er voor de uitoefening van de hobby’s en dergelijke van je kind bepaalde uitgaven moeten gebeuren.
Hier bekijken we een paar voorbeelden, natuurlijk onder voorbehoud van wat je kind wil en aankan:
Ontspanning en vrije tijd
- Melden dat de bewindvoerder moet zorgen voor voldoende audiovisuele ontspanningsmiddelen voor je kind (radio, tv, enz.).
- Dat er regelmatig dvd’s of cd’s gekocht worden van muziek die het kind graag hoort (bv. K3) en series die het kind graag bekijkt (Familie, de Kampioenen enz.).
- Voor een kind dat graag karaoke doet: ze een paar keer per jaar de gelegenheid geven dat uit te oefenen.
- Regelmatig met het kind een wandeling maken of een fietstocht op een aangepaste fiets die mag gekocht worden.
- Van tijd tot tijd met het kind gaan winkelen om zijn/haar kledij aan te schaffen in zijn/haar tegenwoordigheid.
- In dat laatste geval een ijsje of pannenkoek gaan eten met het kind, waarbij het kind gerust ook eens mag trakteren.
- Als het kind graag eens op restaurant gaat eten, het kind mee uit eten nemen.
- Dat je kind eens een concert, musical of toneel kan bijwonen onder begeleiding.
- Dat je kind onder begeleiding kan reizen.
Sociaal contact
- Dat je wenst dat de bewindvoerder en/of vertrouwenspersoon regelmatig – bv. om de twee weken- je kind eens een bezoekje brengt.
- Als je kind graag met de auto meerijdt, dat die kans hem/haar geboden wordt.
- Dat je kind bij familiale aangelegenheden (huwelijk, communie, lentefeest enz.) ook eens en geschenk kan geven.
Verzorging
- Dat je kind - als het dat graag doet - hippo- of asinotherapie kan beleven.
- Dat je kind regelmatig, bv. twee keer per jaar, nieuwe en verzorgde kledij uit goede winkels of boetieks mag kopen.
- Dat je kind goede schoenen heeft.
- Dat je kind goede verzorgingsproducten heeft.
- Dat je kind regelmatig tandartsbezoek kan doen en doktersbezoek, alsook andere medische begeleiding zoals podologie.
- Dat er gelet wordt op de was en strijk.
- Dat voor zijn/haar comfortzorg alle nodige uitgaven mogen gedaan worden.
Al deze dingen kan je in je testament opnemen. Het is verstandig dat te doen.
Bijkomende tips
Je kan ook medische zaken opnemen in je testament. Bijvoorbeeld een lijst toevoegen van de medische handelingen die je kind ondergaat, je kan er bijzetten dat je kind thans bij dokter A en B in behandeling is en dat je wenst, zolang die bepaalde geneesheren werkend zijn, dat de behandeling bij die geneesheer A en B wordt verdergezet.
Een tip voor sociaal contact is enkele jonge mensen te vinden, een ‘bezoekfamilie’ noem ik dat, die van tijd tot tijd eens naar je kind gaan, zodat je kind een zo warm mogelijk menselijk contact heeft als jij er niet meer bent. Kijk daarvoor eens rond bij jonge mensen die wat sociaal gericht zijn, die lid zijn van een jeugdbeweging (Akabe!). Het is in deze tijd zeker niet makkelijk om dat te bekomen, maar het is mogelijk!
