Arbeidsrechtbank Kortrijk vernietigt vermindering van budget

Dit vonnis bevestigt nogmaals dat een vermindering van het budget door het VAPH in strijd is met het Europees Verdrag van de Rechten van De Mens.

Op 16 november vernietigde de arbeidsrechtbank in Kortrijk de vermindering van een toegekende budget PVB. Lees er meer over via deze link.

Belangrijk is dit vonnis voor het VAPH die momenteel plannen heeft om een aantal wachtenden in prioriteitengroep 2 een half budget te geven en op die manier meer mensen te helpen. Het huidig vonnis stelt dat het verminderen van het budget in strijd is met het Europees Verdrag van de Rechten van de Mens  en met artikel 23 van de Grondwet. In artikel 23 staat dat verleende rechten niet mogen worden afgebroken en dat iedere persoon een menswaardig leven moet kunnen leiden. 

Of het toekennen van halve budgetten wel kan, zal dan ook een vraag zijn voor juristen. Men blijft met de zorgvraag voor het volledige budget behouden maar krijgt slechts de helft. Nochtans heeft VAPH daarvoor plannen in een ver gevorderd stadium. Ook wat VAPH noemt de actualisering van toegekende budgetten kan niet. Daarbij oordeelt VAPH dat men minder budget nodig heeft dan bij de toekenning. Dit verminderd budget blijft men behouden. Voor een volledig budget krijgt men dan niet het minste perspectief.

Beroep aantekenen?

Belangrijk is dat wie niet akkoord gaat met een vermindering van zijn toegekend budget 30 dagen tijd heeft om beroep aan te tekenen bij de arbeidsrechtbank na de ontvangst van het VAPH bericht. 

Een suggestie: wie slechts de helft krijgt van zijn  PVB dat door de overheid werd toegezegd, betaalt voortaan ook maar de helft van de personenbelastingen aan de Vlaamse overheid.
