STAN informeert: Welke overeenkomsten mag ik afsluiten als budgethouder én persoonlijk assistent of individueel begeleider?
Uitstel aangepaste richtlijnen naar 1 januari 2025
Vanaf 1 januari 2025 - in plaats van 1 januari 2024 zoals eerder gecommuniceerd - worden er een aantal richtlijnen aangepast rond de combinatie van de rol van budgethouder (van een persoonlijke-assistentiebudget (PAB) of persoonsvolgend budget (PVB)) en persoonlijk assistent of individueel begeleider.
Wat verandert er vanaf 1 januari 2025?
- Stel, u bent budgethouder én (pleeg)ouder van een minderjarig kind, in dat geval:
- Kan u geen arbeidsovereenkomst meer afsluiten met de andere (pleeg)ouder of met uzelf.
- Kan u de andere (pleeg)ouder of uzelf niet meer in dienst nemen als assistent of begeleider via een interimkantoor.
- Maar is het wel nog mogelijk om een takenovereenkomst af te sluiten. In een eenoudergezin kunt u ook een takenovereenkomst afsluiten met uzelf.
- Stel, u bent budgethouder én bewindvoerder of lasthebber van een wilsonbekwame meerderjarige, in dat geval:
- Kan u een andere bewindvoerder, lasthebber of uzelf niet meer in dienst nemen als begeleider via een interimkantoor.
- Bewindvoerders die familielid (tot de tweede graad) of gezinslid zijn van de persoon met de handicap, kunnen elkaar of zichzelf wel tewerkstellen als individueel begeleider via een takenovereenkomst.
Wat gebeurt er met overeenkomsten die reeds bestaan?
De bestaande arbeidsovereenkomsten of overeenkomsten via een interimkantoor kunnen blijven doorlopen zolang er aan deze overeenkomsten geen wijzigingen gebeuren. Echter, indien er wijzigingen doorgevoerd moeten worden, zal er wel een nieuwe overeenkomst moeten worden afgesloten. Deze nieuwe overeenkomst zal bijgevolg moeten voldoen aan de nieuwe richtlijnen die gelden vanaf 1 januari 2025 (zie hierboven).
