Beroep binnen de 3 maanden
Het hof van beroep in Gent heeft de vermindering van het PersoonsvolgendBudget (PVB) ongedaan gemaakt voor een 70-tal budgethouders van de zorgvoorziening De Vleugels in Klerken (de foto's bij dit artikel komen van hun website)
Zo’n 600 budgethouders hebben klacht ingediend bij de arbeidsrechtbank tegen de vermindering van hun budget. Het VAPH ging in beroep en nu oordeelde de rechter in beroep dat een vermindering van het PVB strijdig is met het artikel 23 van de grondwet. Het VAPH mag de voorziene vermindering van het zorgbudget dus niet doorvoeren, aldus het Gentse hof van beroep.
Het vonnis geldt evenwel enkel voor de 70 budgethouders die binnen de voorziene termijn van 3 maanden na de VAPH-brief beroep aantekenden bij de arbeidsrechtbank. Voor wie beroep aantekende is dit rechtspraak waar de rechters voortaan rekening mee zullen houden in hun vonnis.
Veel procedures werden evenwel uitgesteld in het licht van het bovenstaande vonnis en zullen de volgende maanden gevonnist worden.
Nefaste situatie
Voor wie geen beroep aantekende, blijft de eventuele vermindering doorlopen. Een nefaste situatie voor wie de vermindering van budget kan leiden tot een vermindering van zorg wanneer de zorgvoorziening de grote vermindering zelf niet opvangt.
De bedoeling van VAPH om gelijke budgetten te voorzien voor gelijke zorgnoden krijgt hiermee nog een flinke dreun. Bij de invoering van het PersoonsVolgendBudget wist het VAPH en minister Van Deurzen nochtans dat er een herziening zou komen.
