Er zijn een aantal dingen die heel belangrijk zijn om over na te denken in de overgang van minder- naar meerderjarigheid. Een jongere van 18 jaar is volwassen voor de wet en dit brengt een aantal rechten en plichten met zich mee, denk bijvoorbeeld aan stemrecht. - Kan je zoon/dochter, de persoon met een handicap, voldoen aan de rechten en plichten die hij/zij heeft als volwassen persoon? Soms kan de persoon natuurlijk prima zelf beslissingen nemen, maar in andere gevallen is daarbij misschien een steuntje in de rug nodig of is er behoefte aan een tussenpersoon die de beslissingen neemt in plaats van de persoon met een handicap. We spreken dan over zorgvolmacht en bewindvoering.
- Heb je intensieve zorg en ondersteuning nodig dan doe je best een aanvraag voor een persoonsvolgend budget. Heb je al een persoonlijke-assistentie budget of maak je gebruik van een multifunctioneel centrum of van een centrum voor ernstige gedrags- en emotionele stoornissen (GES+ voorziening), dan heb je recht op een persoonsvolgend budget na jeugdhulp (voorheen zorgcontinuïteit genoemd). Om ervoor te zorgen dat jongeren die meerderjarig worden dezelfde zorg kunnen krijgen als toen ze minderjarig waren, kunnen zij beroep doen op deze automatische overgang. De aanvraag moet gedaan worden voor het 22e jaar. Hierover lees je meer in ons hoofdstuk over het persoonsvolgend budget. Begin op tijd met de aanvraag, want de procedure kan wel anderhalf jaar duren en je wilt niet zonder ondersteuning te komen zitten zodra de leeftijd van 22 jaar is bereikt.
- Aan het eind van het middelbaar onderwijs komt de vraag: wat nu? Wat is een zinvolle daginvulling? Hoe voorzie ik (hoe voorziet mijn zoon/dochter) in mijn levensonderhoud? Als er vervangend inkomen nodig is of extra financiële ondersteuning bij dagdagelijkse dingen heb je recht op een inkomensvervangende tegemoetkoming en/of een integratietegemoetkoming. Voorheen kon je deze tegemoetkomingen aanvragen vanaf 21 jaar, maar op 18 januari 2021 werd de leeftijd voor de inkomensvervangende en integratietegemoetkoming verlaagd van 21 naar 18 jaar.
- De verlaging van de leeftijd naar 18 jaar heeft als gevolg dat de tegemoetkomingen overlap hebben met de zorgtoeslag voor kinderen met een specifieke ondersteuningsbehoefte (verhoogde kinderbijslag). Deze laatste ontvang je immers tot het 21e jaar. Het is echter niet mogelijk beide te ontvangen, dus je zult een keuze moeten maken.
